Jivin J over at Jill Stanek’s found this news, of an  Arizona appeals court upholding that state’s new abortion limitations.

Nurse practitioners are no longer allowed to do the mifepristone abortions.  Waiting periods remain in place, and pharmacists right of conscience is upheld with respect to other abortive drugs: the morning after pills.

This is a BIG deal, as the criterion of  “undue burden” for women is defined more stringently.  The fact that the law allows some burden on those seeking abortion is not sufficient for the law to be overturned.

*Note:  Mifepristone, RU-486,  is dispensed by the prescriber or his agent, not pharmacists.  However the chemical analog, ulipristal acetate, or Ella, a morning after pill, is able to be dispensed by pharmacists.

Indiana is set to challenge the injunction set by Judge Tanya Walton Pratt against defunding of abortion.

It is also challenging the US health and human services decision to block amendments to the state medicaid plan.

Both cases will wind up in the US 7th Circuit court of appeals in Chicago.

While the court case concerning Indiana’s new law defunding abortion clinics is decided,  Indiana planned parenthood is closing its clinics for a day, and stopping services to its 9300 Medicaid patients.

There is no expectation for the supporters of planned parenthood to make up the 1.3 million dollar per year shortfall to allow free care for the underprivileged.

Things are not the same for this organization as it is for the pro-life crisis pregnancy care centers.

The Susan G. Komen foundation has been contributing to Planned Parenthood for years, and referring people to that organization for mammograms.   Planned Parenthood has no mammography equipment at its clinics, and refers its patients elsewhere for that cancer screening procedure.

Komen has no plans to defund planned parenthood, nor stop referrring to that organization for nonexistenet mammograms

Obama’s intention, as expressed to the State of Indiana, is that he will force the states to fund abortion with their taxpayer dollars.

The Obama Dept of Health and Human Services  says that the Indiana decision to remove tax funding of abortion providers,  denies needed health care services to  medicaid recipients. Indiana has 28 Planned Parenthood clinics and many hundreds  of other qualified providers  to deliver real  health care to women in the 21 counties affected by the defunding of abortion clinics.  The argument from the HHS  is that defunding planned parenthood restricts choice of providers to  patients dependent on medicaid  funds for their treatment.  (Pharmer notes: this will be the ultimate effect  of Obamacare on everyone).  Here’s the Letter from the Obama HHS  medicaid director  Donald Berwick to Indiana’s  counterpart,  Patricia Casanova.

If Indiana stops funding abortion clinics, as the Federal government is supposed to have done,  the Obama administration intends to cut off  federal funding for all medicaid  patients in the state of Indiana.   His Dept of Health and Human Services, run by the radically pro-abortion Kathleen Sebelius is expected to  threaten  all the states similarly.

The message is loud and clear.  We fully  understand that  providing abortion is a prime directive of the Democrat Party, and its importance supercedes that of all other health care.

Perhaps the states will tire of the federal usurpation of their rights, and dictatorial control by the federal government. It appears thus far that Indiana will be putting up a fight.

Let’s hope the state  doesn’t  cave as Texas did to the TSA gropers.

Remind yourself what Planned Parenthood has been covering up.

Governor Mitch Daniels will probably run for president.  Evidence……. he is going to sign a bill to DEFUND PLANNED PARENTHOOD IN INDIANA. While the decision to sign that bill is good,  Mitch is not conservative enough for the Pharmer.

This bill makes Indiana the first state to put Planned Parenthood in the dumpster where it belongs.

In Sangamon County, Circuit Court Judge John Belz ruled that Illinois pharmacists can’t be forced to dispense the morning after pills against their own ethical standards and religious beliefs.

Opponents promise to immediately challenge this ruling, but Atty. Francis J. Manion,  ACLJ senior counsel, who represented the conscientiously objecting pharmacists notes that the court ruling addresses specific arguments for which the Illinois state attorneys were not able to provide evidence.   For example,  they were not able to argue that a single woman had been prevented from obtaining her morning after pills by a pharmacist who would not personally provide them.  For that reason, an appeal on their part will likely be a waste of Illinois’  negative financial resources.

The Illinois edict, which was overturned in the circuit court, had basically been designed  by Planned Parenthood, and this is the case for many other unconstitutional state laws opposing the human rights of health care professionals.

The article linked addresses  the battle over   conscience rights in numerous other states, including Wisconsin, Washington, where the  pharmacists  are in trouble, and in several more states which have recently supported pharmacists of conscience.

Scroll down in this blog to see the prescriber information for  Plan B, which clearly contradicts  the false premise of the Wisconsin regulations,  forcing pharmacists to dispense Plan B (as well as all other hormonal birth control).    Expect a new  legal battle to erupt in that state as the pharmacy owners are forced to apply the legislation and fire conscientiously objecting pharmacists.  Wisconsin’s legislation targeting the pharmacists was hidden in budget bills by the democrat legislature, and passed without much notice.  The newer state government might find cost containment benefits in rescinding the legislation.

The legal battle  is  ongoing in the state of Washington,  which the pro-abortion Governor Gregoire and her Board of Pharmacy  might drive all the way to the U.S. Supreme Court.   It might be the crowning achievement of their careers.

With the big change in state governments after 2010, causing them to lean heavily towards the right,  multitudinous prolife bills and legislation have resulted.

Planned Parenthood has been exposed under the spotlight  of  LiveAction and numerous other pro-life groups, and  an enhanced  public awareness of its slimy nature has been the result.

This has left planned parenthood feeling too much trepidation to  mount legal challenges in court against the new legislation.  The corporation claims that it lacks standing to challenge, the fetal pain laws, for one example.  Lack of standing was never a problem in the past.

Ask yourself what standing did  planned parenthood have in forcing other health care providers to participate in abortion, or intervening in the cases of those who want to avoid such activity.

Pro-life health care professionals  would like to see less of planned parenthood’s meddling in their  practice.  Seeing the nation’s largest abortion provider  on the run is a pleasant experience.
