Kathleen (Cruella) Sebelius, has slightly broadened conscience exceptions in the HHS mandate. The new amendment still shows her desire to remove all of those who religiously object to paying for birth control, abortion and sterilizations, from the world of business. This is much worse than a status of dhimmitude for strict opponents of abortion, and would serve to force them out of the taxable portion of the U.S. economy. With this amendment, the administration shows that it is not serious about addressing the debt problem by allowing the INFLUX of tax dollars.

The HHS mandate remains a significant part of the many pronged effort by the Obama administration to remove the United States from its position as a world economic leader.

When FORMER Ohio Rep. Steve Driehaus lost his 2010 bid against Republican Steve Chabot, he threw a temper tantrum directed at the Susan B. Anthony list.  The latter pro-life group had put up billboards citing Driehaus for his abortion support, because he voted in favor of Obamacare.  At first Driehaus pursued a criminal charges against Marjorie Dannefelser, of the SBA list, with the Ohio Elections board.  That effort was abandoned for an attempt to turn his loss in to money with a civil defamation suit, claiming that the SBA list cost him his job.

This suit was allowed to proceed, but eventually was decided against sore loser, Driehaus, by Judge Timothy Black.   This Obama appointed Judge, a former director of planned parenthood, initially  supported Driehaus’s legal pursuits, but eventually tipped in favor of the SBA List.  Possible inducements for this decision probably included the ACLU’s  backing of  the SBA List, (and their own interests) as well as the recent Supreme Court decision of the Alvarez vs U.S. (Stolen Valor) case.

This legal maneuver doesn’t  enhance the public image of Catholic Health Initiatives, and you can bet that Obama’s vultures are circling.  It appears from reports that Lori Stodghill lost her life at Thomas More Hospital in Canon City due to a pulmonary embolism which led to a massive heart attack.  Her two unborn babies also died, and  the current lawsuit argues that this need not have happened.  Dr. Pelham Staples, the  hospital’s obstetrician on call did not answer his pager, for reasons unspecified in the reports.

The surprise inside this case is the lawyer, proffering a defense that the babies are not legal persons, and therefore are not protected by Colorado malpractice statutes.  Lawyer Jason Langley argued that the court “should not overturn the long-standing rule in Colorado that the term ‘person,’ as is used in the Wrongful Death Act, encompasses only individuals born alive. Colorado state courts define ‘person’ under the Act to include only those born alive. Therefore Plaintiffs cannot maintain wrongful death claims based on two unborn fetuses.”

This kind of defense is not a good idea for Catholic Health Initiatives for a number of ethical reasons.   It could also cost their member institutions  more in philanthropic contributions than the cost of losing the Stodghill lawsuit.

It also undermines any Catholic objections to the HHS mandate.  Obama’s team must be laughing themselves silly to see such a bad maneuver by this significant group of  ideological opponents.

Hobby Lobby Will Defy Obama HHS Mandate

The family of David Green, which owns the 500 plus Hobby Lobby stores, with 13000 employees are likely to incur a half billion dollar cost, while waiting for their challenge to the HHS mandate to be heard in court.    Despite this huge financial threat to their company’s existence,  the Greens have decided to adhere to their religious convictions, and defy Obama’s demand that they fund abortive forms of birth control for their employees.

Prayers for the success of David Green, his family and his company.  They’re putting the commandments of God ahead of the commands of  the most pro-abortion president in history.

If the United States Conference of Catholic Bishops had felt this strongly about God’s commandment to avoid willful killing, there would NEVER have been an  HHS mandate at all!!

Obama’s appointee, Supreme Court Justice Sonia Sotomayor refused to grant an emergency ruling blocking the effects of Obama’s HHS mandate on Hobby Lobby and it’s sister company, Mardel Inc.

She stated that while the legal requirements for an emergency ruling were not met, the companies may continue to pursue their lawsuits in the lower courts.

Attorneys for the government incorrectly deny the fact that the birth control drugs have abortive mechanisms of action. The government continues to pursue its interest in regulating the populations of its constituency by unethical and deceptive means.

“This is a big #^@&(N deal”…as Joe Biden would say.    A Federal court is blocking Obamanator’s HHS mandate for O’Brien Industrial Holdings, which operates several smaller companies: Christy Industrial Services, Christy Minerals Co., and Christy Refractories Co. The owner, Frank O’Brien is a Catholic, who wishes to adhere to his religious beliefs in operating his businesses.

The three judge panel of the Eighth Circuit Court of Appeals granted a preliminary injunction which blocks the HHS mandates unconstitutional effects upon this privately owned company. Among the many lawsuits challenging the HHS mandate, this is the first decision rendered by a Federal appeals court.

Frank Manion of the American Center for Law and Justice is handling this case, which was first dismissed by a Federal district court judge before it was taken before the Eighth Circuit Court. The ACLJ has filed two other lawsuits against the Federal Government regarding the HHS mandate, and numerous Amicus briefs for other court challenges.

Atheism is an act of faith.  Its default belief,  without evidence, is  that the universes are self generating and self maintaining – in the absence of the Creator which they deny.

The IRS has been running away from dealing with free speech challenges by over a thousand pastors, on Pulpit Freedom Sunday, probably because they know they’ll lose.

It’s difficult for the IRS  to tell churches that they can’t keep non-profit status if they convey political preferences, with Cecile Richards of the NON- non-profit, Planned Unparenthood, so vigorously supporting and campaigning for the Abortionist in Chief, Obama.

Atheists are getting frustrated at the slow process of compelling complete fealty to the state.  Their Freedom From Religion Foundation, FFRC, is suing to compel the IRS to move against the churches and compel enforcement of the Johnson tax regulation from the 1950s, limiting the free speech of non-profits.

Forcing the hand of the IRS might bring about the early defeat and nullification of these IRS regulations.  It’s what the Pulpit Freedom Sunday Pastors have been hoping for: a chance to win back 1st amendment rights, and beat the tax-man once and for all.

For the time being, the IRS is rolling over on the issue of tax exemption for churches which dare to publicly address political issues and candidate endorsements.
Over 1500 pastors challenged the IRS this year on the 5th annual Pulpit Freedom Sunday. The response from the IRS is that the enforcement of the so called tax penalties for non-profits, which exhibit a political view, will be held in abeyance until the tax-masters get their regulations in order.

Influencing this decision is a court determination that the Internal Revenue Service needs to establish which officials have sufficient rank for setting and enforcing the policies. Another unspoken problem is the glaring partisanship of the supposed ‘non-profit’, Planned Unparenthood. The IRS would obviously have to remove tax exempt status from the abortion giant if it were to remove that of any churches. Uneven enforcement of regulations does not hold up well from a legal standpoint.

For now, it is open season FOR politics from the pulpit.

Pastors and preachers may freely tell their congregations that Obama is more pro-abortion than 99 percent of abortionists. An exception is Kermit Gosnell, whose trial for infanticides starts in March.
